This is a translation. The Hebrew text is the binding version.
1. General
1.1 "Made to Measure" (the "Booklet") is an original work by Hasan Awida, occupational therapist and gerontologist (the "Author"). The Booklet includes, among other things, activities, worksheets and their solutions, on-screen games, demo videos, illustrations and photos, stories and albums, texts and translations, design, structure and method (together, the "Content").
1.2 Buying, registering, opening the personal link or using the Content means you accept these terms. If you do not accept them, you may not buy or use the Content.
1.3 Seller: Hasan Awida. Contact: hasanawida123h@gmail.com · WhatsApp 0523200206.
2. Copyright
2.1 All rights in the Content, including copyright, are reserved to the Author. The Content is protected under the Israeli Copyright Act, 2007, and international treaties.
2.2 A purchase grants a limited license to use the Content only, as set out in section 3. It does not transfer ownership or any other right in the Content.
2.3 The names "Made to Measure" (תפור לפי מידה) and OTTRIX, the OTTRIX logo, the Author's logo and the Booklet's identifying marks belong to the Author.
3. The license
3.1 Personal license: for one person only (a staff member, a therapist or a family member), for use in their work with the people they care for or with their family. It is personal and may not be transferred or shared.
3.2 Institution license: for one institution at one site (a nursing home, day center, assisted living and the like), for use by its staff only and within the institution.
3.3 Printing: you may print pages of the Content you bought, for use with the licensee's own clients or residents only. Printed pages may not be sold, distributed or given to anyone outside the license.
3.4 Access to purchased Content is granted for a one-time payment, with no time limit, as long as these terms are kept. Prices include VAT, and a tax invoice-receipt is issued for every payment.
4. What is not allowed
Without the Author's prior written permission, you may not, in any way or by any means:
4.1 copy, reproduce, scan, photograph or record the Content, in whole or in part, beyond the printing allowed in section 3.3;
4.2 distribute, send, share, publish or upload the Content or the personal link: online, on social networks, in WhatsApp groups, by email, on shared drives or in any other way;
4.3 give, lend, sell or rent the personal link or access to another person;
4.4 translate, adapt or change the Content or create derivative works from it, including activities, worksheets, games, kits, presentations, courses and trainings based on it;
4.5 remove, hide or change the licensee's name, the license number or the copyright notices in the Content;
4.6 use the Content commercially, including paid instruction and trainings, except for ordinary professional use in work with clients under the license.
5. Artificial intelligence: an express prohibition
The Author does not permit any use of the Content by means of artificial intelligence. In particular, you may not:
5.1 upload, input, paste, scan or photograph the Content, in whole or in part (including screenshots and printed pages), into any AI system, tool, chat, model or service, such as ChatGPT, Claude, Gemini or Copilot;
5.2 use AI to summarize, rephrase, translate, adapt or imitate the Content, or to derive from it activities, worksheets, games, kits, ideas, structure or method, in the style of the Booklet or based on it;
5.3 use the Content to train, fine-tune or evaluate AI models, or for text and data mining;
5.4 collect the Content automatically, with bots, scripts or similar tools.
5.5 This prohibition also applies to anyone the licensee gives Content or printed pages to, and the licensee is responsible for it.
6. The personal link and protection of the Content
6.1 After purchase, the buyer receives a personal link. It opens on a limited number of devices: up to 3 with a personal license and up to 15 with an institution license.
6.2 Every printed page shows the licensee's name and license number. The buyer agrees to this marking.
6.3 The Author may monitor use of the link (such as the number of devices and prints) to detect prohibited sharing, and may block access where use against these terms is suspected.
7. Breach
7.1 A breach of these terms cancels the license immediately, without refund.
7.2 The Author may take legal action, including a claim under the Israeli Copyright Act, 2007, under which a court may award statutory damages without proof of harm of up to ₪100,000 per infringement, and a claim for breach of this agreement.
8. Cancellation and refunds
8.1 The Content is digital information. Under the Israeli Consumer Protection Law, 1981, the right to cancel a distance sale does not apply to "information" as defined in the Computers Law, 1995. The purchase therefore cannot be canceled or refunded once the personal link has been sent.
8.2 If a technical fault prevents use of the Content and is not fixed within 14 days of contacting us, you will get a full refund.
9. Responsibility
9.1 The Booklet is an aid for choosing activities. It does not replace a professional assessment, treatment or an individual care plan.
9.2 Matching each activity to the person, and safety and supervision during it, are the responsibility of whoever runs it (for example: food and allergies, small objects, sharp objects, physical condition).
9.3 The Author is not responsible for harm caused by using the Content against its instructions.
10. Privacy
10.1 At purchase we collect your name, phone and email, and the institution's name for an institution license, to issue the license, mark the pages, provide service and contact you.
10.2 Payment details (credit card, Bit) are processed directly by the payment company and are not stored by us.
10.3 The information is not sold or passed to others, except to service providers needed to run the site (hosting, payment, issuing receipts), or as required by law.
10.4 You may ask to see, correct or delete your information by contacting us. Deleting it cancels access to the Content.
11. Changes
The Author may update these terms. Each purchase is governed by the terms in force at the time of purchase.
12. Law and jurisdiction
These terms are governed by the laws of the State of Israel only. The competent courts in Israel have exclusive jurisdiction.
13. Languages
These terms are translated into Arabic, English and Russian. If there is a conflict, the Hebrew version prevails.
